PRIVACY STATEMENT

  1. Associated Marine Officers’ and Seamen’s Union of the Philippines (AMOSUP) is a non-profit organization that aims to provide world class services to its seafaring members. It established the Provident Fund, which is a benefit scheme for AMOSUP members wherein participating Companies contribute to the Fund of the seafarer’s account.
  2. AMOSUP Provident Fund is committed to protect your personal data in compliance with Republic Act No. 10173, otherwise known as the Data Privacy Act of 2012 (DPA).
  3. For AMOSUP Provident Fund to provide its services, it is necessary to collect information that may be classified as Personal or Sensitive Personal Information. 
This Notice describes: 
    • What data we collect, how we collect it, and why;
    • How we use that data and with whom we share it;
    • How you can access and update that information; and
    • How we protect the information we store about you.

DEFINITION OF TERMS

  1. Data Subject refers to an individual whose personal, sensitive personal, or privileged information is processed.
  2. Personal Data refers either to Personal Information or Sensitive Personal Information as defined in the Data Privacy Act and its Implementing Rules and Regulations.
  3. Personal Information refers to any information whether recorded in a material form or not, from which the identity of an individual is apparent or can be reasonably and directly ascertained by the entity holding the information, or when put together with other information would directly and certainly identify an individual.
  4. Sensitive Personal Information refers to personal information:
    • About an individual’s race, ethnic origin, marital status, age, color, and religious, philosophical or political affiliations;
    • About an individual’s health, education, genetic or sexual life of a person, or to any proceeding for any offense committed or alleged to have been committed by such person, the disposal of such proceedings, or the sentence of any court in such proceedings;
    • Issued by government agencies peculiar to an individual which includes, but not limited to, social security numbers, previous or current health records, licenses or its denials, suspension or revocation, and tax returns; and
    • Specifically established by an executive order or an act of Congress to be kept classified.

    • Affidavit of Close Shop
    • Notarized Special Power of Attorney
    • Consularized Special Power of Attorney
    • Visa (for Migrating Applicant)
    • Contract of Employment

  2. PURPOSE/S OF COLLECTION AND PROCESSING
    • These personal data you have provided us will be used to process your Application with us for the purposes such as but not limited to:
    • For identification
    • For communication purposes
    • To verify if the member is qualified for retirement
    • To assist in identifying member’s beneficiary/ies
    • To assess if member is qualified to claim
    • To determine member’s employer for verification
    • To determine the rightful beneficiary/ies in case of death
    • To verify member’s information
    • For approval of Application
    • In case member cannot process his/her Application personally and will appoint authorized representative instead
    • To deposit the Provident Fund check/amount to the bank account of the member
    • For certification of facts and information provident by the member/member’s representative
    • For security and order purposes.
  3. HOW WE COLLECT IT;
    • Information above may be collected through the following mediums:

      • Provident Fund official emails and other contact details

DISCLOSURE, DATA PROTECTION AND SECURITY MEASURES, STORAGE AND RETENTION;

  1. DISCLOSURE - WHOM WE SHARE IT;
    • Only authorized AMOSUP personnel shall be granted access to process the data you have provided.
    • However, your personal data will also be disclosed to the following branches/institutions for the purpose/s written herein.
      • Within AMOSUP Departments – for coordination of AMOSUP benefits
      • Bank Institutions – for the issuance of the check for payment of your provident fund.

        5. Philtrust Bank Head Office, UN Ave. Cor. San Marcelino, Manila and/or;
        6. Union Bank, G/F BF Condo Bldg., A. Soriano Sr. Ave. Intramuros, Manila
      • MJO General Service and Contractor Employees assigned for general administrative works – AMOSUP authorized 3rd party service provider. (With signed Non-Disclosure Agreement)
      • Law enforcement and government agencies performing their governmental and investigatory functions.
  2. HOW WE PROTECT THE DATA WE COLLECTED
    • We make sure that the personal data collected stays private and secure by implementing a combination of organizational, physical, and technical measures that follow widely accepted data protection and security standards. Among the measures we implements are the following:
      • Establishing access control policies for both digital and physical systems to prevent unauthorized access to personal data.
      • Incorporating security measures to shield against natural disasters, power disruptions, external intrusions, and similar risks
      • Implementing Confidentiality and Non-Disclosure Agreements for our employees and third-party provider’s employees and Data Sharing/Processing Agreements for our third-party service providers.
      • Implementing technical measures to protect our computers and databases against accidental, unlawful, or unauthorized use, interference, or access.
  3. STORAGE AND RETENTION
    1. All collected information is securely stored in an online and physical database.
    2. For claims applications, electronic copies of personal data shall be retained in our database 10 years from the date all Union benefits have been fully claimed. Meanwhile, physical copies of personal data shall be retained for five (5) years from the date of the last approved application.

RIGHTS OF MEMBERS AS DATA SUBJECT

  1. As Data Subject you have the following rights:
    • Right to be informed. As a data subject you have the right to be informed how your personal details are being processed by AMOSUP.
    • Right to Object. As a data subject you have the right to object to the processing of your personal data.
    • Right to Access. As a data subject you have the right to access and view the information you have provided.
    • Right to Rectification. As a data subject you have the right to correct any inaccuracy regarding your personal data and have the same corrected.
    • Right to Withdraw Consent and Erasure or Blocking. As a data subject you have the right to withdraw your consent and have the same destroyed and erased from AMOSUP filing system.
    • Right to Damages. As a data subject you shall be indemnified for any damages sustained due to such inaccurate, incomplete, outdated, false, unlawfully obtained or unauthorized use of personal data, taking into account any violation of his or her rights and freedoms as data subject.    
    • Right to Data Portability. As a data subject, you have the right to obtain from the PIC a copy of your personal data and/or have the same transmitted from one PIC to another, in an electronic or structured format that is commonly used.
    • Right to File a Complaint. As a data subject, you have the right to file a complaint to the National Privacy Commission (NPC) to address grievances related to the misuse or mishandling of your personal data.
